Trading & Market Data Disclaimer

This Trading & Market Data Disclaimer ("Disclaimer") applies to all access to and use of the Pudzee Copilot platform and related software, tools, dashboards, browser extensions, and services (collectively, the "Service"), operated by Pudzee LLC ("Pudzee," "we," "us," or "our").

This Disclaimer is incorporated by reference into the Terms of Service and forms part of the binding agreement between you and Pudzee.

1. No Investment, Trading, or Financial Advice

The Service does not provide investment, trading, financial, legal, or tax advice.

Nothing provided through the Service constitutes:

  • A recommendation or solicitation to buy, sell, or hold any security, futures contract, option, digital asset, or other financial instrument
  • Trading instructions or execution guidance
  • Personalized advice or suitability determinations

You are solely responsible for determining whether any trade, strategy, or activity is appropriate for you.

2. Not a Signal Service

The Service is not a signal service.

Any labels, analytics, classifications, alerts, scores, tags, indicators, annotations, or descriptions presented by the Service are informational and interpretive only and must not be interpreted as trade signals, alerts, or instructions.

The Service does not tell you:

  • What to trade
  • When to trade
  • How to trade

3. Interpretive, Model-Derived, Non-Factual Outputs

All outputs generated by the Service are produced using analytical models, assumptions, heuristics, rules, and interpretive frameworks.

The Service may include features such as Market Internals analytics, Options Flow analytics including model interpretations of gamma, vanna, charm, and related options-market dynamics (including references to ATM focus, stability indicators, degradation states, or similar terminology), and other contextual classifications.

You expressly acknowledge and agree that:

  • Such terminology reflects internal model interpretations and not verified facts about market participants, dealer hedging activity, institutional positioning, or real-time capital flows
  • Labels such as "stable," "degraded," "fluid," "muted," "mixed," "dispersed," or similar descriptors are internal confidence or context indicators only
  • These classifications do not predict, guarantee, or imply future price behavior or market direction

You expressly acknowledge and agree that:

  • Outputs are model-derived interpretations, not statements of fact
  • Outputs do not represent actual, complete, or real-time market conditions
  • Outputs may be incorrect, incomplete, delayed, unstable, revised, or misleading
  • Different methodologies could reasonably produce materially different interpretations from the same data

The Service may present outputs that appear authoritative, confident, precise, or actionable but are nonetheless incorrect.

4. No Reliance; User Responsibility

The Service is not designed or intended to be relied upon for trading, execution, or risk-management decisions.

You expressly acknowledge and agree that:

  • You will not rely on the Service to make trading or investment decisions
  • Any reliance you place on the Service is unreasonable and at your sole risk
  • You retain full responsibility for evaluating, managing, and executing any trades or strategies

5. Market Data Limitations

The Service may display, process, or reference market data obtained from third-party sources.

You acknowledge and agree that:

  • Market data may be delayed, incomplete, inaccurate, corrupted, or unavailable
  • Data feeds may experience latency, outages, or interruptions
  • Pudzee does not independently verify third-party market data
  • Pudzee does not guarantee the accuracy, timeliness, or completeness of any market data

Outputs may appear current or complete even when underlying data is delayed or missing.

6. Third-Party and Affiliate Statements

Pudzee does not authorize any third party or affiliate to make representations regarding the Service.

You expressly acknowledge and agree that:

  • Statements made by affiliates, influencers, partners, or other third parties are not authorized, endorsed, or approved by Pudzee
  • You may not rely on any statements made by third parties or affiliates
  • Only statements published directly by Pudzee through its official websites, applications, and documentation govern the nature of the Service

Any third-party or affiliate statements are legally irrelevant to your contractual relationship with Pudzee.

7. No Performance or Accuracy Guarantees

The Service does not guarantee:

  • Accuracy or correctness of outputs
  • Completeness of information
  • Profitability or favorable outcomes
  • Risk reduction or loss prevention
  • Consistency of results

Any hypothetical, illustrative, historical, or simulated examples (if displayed) are provided for demonstration purposes only and are not indicative of future results.

8. No Duty to Update or Correct

Pudzee has no obligation to:

  • Update outputs in real time
  • Correct errors or inaccuracies
  • Notify users of changing market conditions
  • Maintain historical consistency of interpretations

9. Limitation of Responsibility

To the maximum extent permitted by law, Pudzee shall not be responsible or liable for any losses, damages, or consequences arising from:

  • Trading losses or missed opportunities
  • Market volatility, gaps, or illiquidity
  • Data errors, delays, or outages
  • Misinterpretation or misuse of outputs
  • Decisions made based on the Service

Use of the Service is entirely at your own risk.

10. Acknowledgment

By accessing or using the Service, you acknowledge that:

  • You understand the speculative nature of trading
  • You understand the limitations of analytical software and market data
  • The Service is not a substitute for independent judgment
  • You agree to this Disclaimer, the Risk Disclosure Statement, and the Terms of Service

If you do not agree, you must not use the Service.

11. No Redistribution or Commercial Use

Unless expressly authorized in writing by Pudzee, you may not:

  • Copy, reproduce, redistribute, rebroadcast, or resell Service outputs
  • Publish derived analytics or model classifications as your own
  • Commercially exploit Service interpretations or classifications

All outputs remain proprietary to Pudzee and are provided solely for your personal, non-commercial use.

12. Precedence

This Disclaimer is incorporated into and governed by the Terms of Service. In the event of any conflict or inconsistency, the Terms of Service shall control.
