Trading & Market Data Disclaimer

This Trading & Market Data Disclaimer ("Disclaimer") applies to all access to and use of the Pudzee Copilot platform and related software, tools, dashboards, websites, browser-based panels, communications, and services (collectively, the "Service"), operated by Pudzee LLC ("Pudzee," "we," "us," or "our").

This Disclaimer is incorporated by reference into the Terms of Service and must be read together with the Risk Disclosure Statement. Capitalized terms not defined here have the meanings given in the Terms of Service.

1. No Investment, Trading, or Financial Advice

The Service does not provide investment, trading, financial, legal, tax, or accounting advice.

Nothing provided through the Service constitutes:

  • A recommendation, solicitation, offer, or advice to buy, sell, hold, or avoid any security, futures contract, option, digital asset, or other financial instrument
  • Personalized guidance, suitability analysis, or individualized strategy advice
  • Execution instructions, broker instructions, or trade management directions
  • A guarantee or representation that any trade, instrument, level, or strategy is appropriate for you

You are solely responsible for determining whether any trade, strategy, instrument, or activity is appropriate for you.

2. Informational Alerts, Commentary, and Analytical Content Only

The Service may present or make available trade alerts, near-real-time commentary, Execution Map levels, Trade Desk Insights, Performance Dashboard views, Market State, Market Internals, Options Flow, and related outputs.

All such content is informational, interpretive, and commentary-based only. It is not a directive, command, or instruction that you should enter, exit, scale, reduce, hedge, or otherwise manage any trade in any particular manner.

The Service does not tell you:

  • What you must trade
  • When you must trade
  • How much you must trade
  • How you must manage, hedge, or exit a position

Any decision to act on, ignore, delay, or attempt to mirror anything shown in the Service is made solely by you and entirely at your own risk.

3. No Personalized Recommendations or Suitability Determinations

The Service is not personalized to your financial circumstances, objectives, experience, account size, risk tolerance, broker limitations, prop-firm rules, jurisdiction, tax situation, or suitability profile.

You acknowledge and agree that:

  • The Service does not know whether a trade, product, level, or alert is suitable for you
  • The Service does not account for your margin, buying power, drawdown, liquidity constraints, commissions, taxes, or account restrictions
  • Identical information can produce materially different outcomes for different users depending on their account type, execution quality, fees, timing, and platform constraints

4. Interpretive, Model-Derived, and Non-Factual Outputs

All outputs generated by the Service may rely on analytical models, heuristics, assumptions, internal scoring, rule-based logic, manual commentary, normalization, aggregation, and other interpretive frameworks.

This includes, without limitation:

  • Trade alerts and related trade commentary
  • Execution Map levels and structural references
  • Trade Desk Insights and narrative, manual, or subjective session analysis
  • Performance Dashboard summaries, logs, charts, and statistics
  • Market State classifications and confidence indicators
  • Market Internals analytics
  • Options Flow analytics, including model interpretations of gamma, vanna, charm, and related terminology
  • Any health, confidence, quality, engagement, resolution, credits-related, or similar indicators, dials, badges, or statuses that may be displayed as part of the Service

You expressly acknowledge and agree that:

  • These outputs are interpretations, not verified facts
  • They do not necessarily reflect actual institutional intent, dealer positioning, order flow, or future market direction
  • Labels, descriptors, and classifications may sound precise or authoritative while still being incomplete, delayed, unstable, or wrong
  • Different methodologies could reasonably generate materially different interpretations from the same underlying market information

The Service may present outputs that appear timely, precise, high-confidence, authoritative, or actionable - including confidence scores, state labels, health-style dials, quality badges, or similar indicators - but are nonetheless incorrect, stale, incomplete, or misleading.

5. Market Data Limitations

The Service may display, process, reference, summarize, transform, or redistribute market data or market-data-derived information obtained from third-party sources.

You acknowledge and agree that:

  • Market data may be delayed, incomplete, inaccurate, stale, corrupted, or unavailable
  • Third-party feeds may experience outages, interruptions, latency, sequencing problems, normalization errors, or other failures
  • Pudzee does not independently verify all third-party market data or all derived calculations based on that data
  • Different brokers, platforms, exchanges, or vendors may show different prices, timestamps, sizes, volumes, classifications, or levels for the same apparent market event
  • Options Flow, quality, or similar derived indicators may degrade or become unreliable during volatility, feed interruptions, or market stress
  • A display that looks current, complete, or synchronized may still rely on delayed, partial, or degraded data

Pudzee does not guarantee the accuracy, timeliness, completeness, sequencing, or availability of any market data or market-data-derived output.

6. Trade Alert, Timing, and Reproducibility Limitations

Trade alerts and commentary may refer to entries, scales, reductions, exits, or other market developments. You acknowledge and agree that:

  • Alerts may be delayed, partial, corrected, revised, omitted, duplicated, interrupted, or unavailable
  • You may see an alert after the relevant market conditions have materially changed
  • You may be unable to obtain the same price, fill, size, timing, liquidity, or execution shown or implied by the Service
  • Pudzee and its personnel may act at different times, prices, sizes, instruments, or under different account conditions than you
  • Pudzee has no obligation to disclose every trade, scale, reduction, exit, or market view
  • Your pass, session window, or other access entitlement may expire during volatile or time-sensitive trading periods, which may disconnect or limit your access mid-session

The Service is not suitable for users who require synchronized execution, guaranteed fills, broker-level precision, or real-time certainty.

7. Performance Information and Historical Examples

The Service may display performance metrics, trade logs, account summaries, win rates, profit factors, durations, charts, historical summaries, or other performance-related information.

You acknowledge and agree that:

  • Performance information may be based on Pudzee-designated accounts, meaning accounts selected by Pudzee in its sole discretion for display purposes, linked trading-account/profile data where applicable, internal logs, broker exports, reconciliations, corrected records, or internal accounting methods
  • Performance information may be provisional, delayed, incomplete, unaudited, restated, reclassified, or corrected from time to time
  • Past performance, displayed statistics, historical examples, and illustrative trade records are not guarantees of future performance or user outcomes
  • Your results may differ materially because of account size, contract size, product choice, liquidity, latency, fees, commissions, taxes, slippage, broker technology, or prop-firm rules
  • Performance information may reflect trading in Micro contracts or other instruments with different notional exposure than the instruments a user may choose to trade, which can materially affect outcomes and comparability

Any hypothetical, illustrative, historical, or simulated example is provided only for informational or demonstrative purposes and is not indicative of future results.

8. No Reliance; Independent Judgment Required

The Service is not designed or intended to be relied upon for trading, execution, suitability, or risk-management decisions.

You expressly acknowledge and agree that:

  • You will not rely on the Service as a substitute for your own analysis, judgment, or professional advice
  • Any reliance you place on the Service is unreasonable and at your sole risk
  • You retain full responsibility for evaluating, verifying, and managing all trades, positions, strategies, and account decisions

9. Broker, Exchange, and Prop-Firm Compliance

The Service does not monitor or enforce compliance with your broker, exchange, clearing firm, prop-firm, or platform rules.

You expressly acknowledge and agree that:

  • Any alert, level, or commentary item shown by the Service could be inconsistent with your account's position limits, drawdown limits, daily loss limits, trading-hour restrictions, product restrictions, margin requirements, or other rules
  • Pudzee does not determine whether a trade idea, alert, or analytical output is permitted under your broker, exchange, prop-firm, or account-specific rules
  • You are solely responsible for confirming that any action you take complies with all rules, agreements, restrictions, and legal obligations applicable to your account and jurisdiction

10. Third-Party and Affiliate Statements

Pudzee does not authorize any affiliate, influencer, partner, or other third party to alter the nature of the Service or to make binding representations on Pudzee's behalf.

You expressly acknowledge and agree that:

  • Statements by affiliates, influencers, partners, or third parties are not authorized trading advice from Pudzee
  • You may not rely on third-party statements as modifying this Disclaimer, the Risk Disclosure Statement, or the Terms of Service
  • Only statements published directly by Pudzee through its official website, applications, or legal documents govern the nature of the Service

11. No Guarantees and No Duty to Update

The Service does not guarantee:

  • Accuracy or correctness of outputs
  • Completeness or timeliness of information
  • Profitability, favorable outcomes, or risk reduction
  • Consistency, continuity, or reproducibility of results
  • Real-time updates, corrections, or historical consistency of interpretations

Pudzee has no obligation to update outputs in real time, correct errors immediately, notify users of changing market conditions, or maintain uninterrupted continuity of any particular output, feature, or analytical interpretation.

12. No Redistribution or Commercial Use

Unless expressly authorized in writing by Pudzee, you may not:

  • Copy, reproduce, redistribute, rebroadcast, resell, or sublicense Service outputs
  • Publish or present Pudzee outputs, analytics, alerts, or model classifications as your own
  • Commercially exploit Service commentary, derived interpretations, or market-data presentations

All Service outputs remain proprietary to Pudzee or its licensors and are provided solely for your permitted personal use.

13. Acknowledgment

By accessing or using the Service, you acknowledge that:

  • You understand the speculative nature of trading and the limitations of market-data-driven software
  • The Service is not a substitute for independent judgment or professional advice
  • The Service may display delayed, partial, interpretive, or incorrect information
  • You agree to this Disclaimer, the Risk Disclosure Statement, and the Terms of Service

If you do not agree, you must not use the Service.

14. Precedence

This Disclaimer is incorporated into and governed by the Terms of Service. In the event of any conflict or inconsistency, the Terms of Service control.
