Refund & Cancellation Policy

This Refund & Cancellation Policy ("Policy") governs purchases, payments, cancellations, chargebacks, credits, add-on access units, and related access rights for the Pudzee Copilot platform and related software, tools, dashboards, websites, browser-based panels, communications, and services (collectively, the "Service"), operated by Pudzee LLC ("Pudzee," "we," "us," or "our").

This Policy is incorporated by reference into the Terms of Service and forms part of the binding agreement between you and Pudzee.

1. Access Fees; Not Outcomes

All fees charged by Pudzee are charged solely for access to the Service and not for results, performance, accuracy, alert timing, execution quality, profitability, suitability, or outcomes of any kind.

For purposes of this Policy, "access" means the technical ability to receive the applicable license, entitlement, pass, session access, or feature access offered in the purchase flow, regardless of:

  • Whether you use the Service
  • Whether you agree with any output or commentary
  • Whether any alert, level, or market view proves useful
  • Whether you obtain any trading result
  • Whether market conditions change rapidly, unfavorably, or unexpectedly

Trading losses, missed opportunities, dissatisfaction, disagreement with interpretations, and inability to replicate trades do not create a refund right.

2. Passes, Access Windows, and Activation

2.1 Nature of Passes

Pudzee currently offers one-time, time-limited access purchases unless a specific offering expressly states otherwise.

Passes and similar access products are limited licenses to access designated Service features during the access window, session, or term shown in the applicable purchase flow.

Access rights are licenses only. They are not property, stored value, bank deposits, cash equivalents, or financial instruments.

2.2 Activation

Access is considered issued or activated when Pudzee grants the applicable entitlement, or when the applicable access window begins, whichever occurs first.

Activation does not depend on login activity, feature usage, alert consumption, trading activity, or user interaction.

2.3 Expiration

Passes and session-based access automatically expire at the end of the applicable access window or term.

Expiration occurs regardless of:

  • Whether you log in
  • Whether you actively use the Service
  • Whether you agree with outputs
  • Whether data quality is degraded or market conditions are volatile
  • Whether you experience favorable or unfavorable trading outcomes

Unused time does not roll over and has no cash value.

2.4 Interruptions and Timing

Temporary interruptions, latency, stale data, partial feature degradation, or pass/session expiration during a trading period do not extend the access window unless Pudzee determines, in its sole discretion, that a material outage occurred under Section 6.

3. Credits, Add-On Access Units, and Internal Credit Restoration

If the Service offers internal credits, add-on credits, PUB reload purchases, or similar feature access units, those units:

  • Are internal Service access units only
  • Have no cash value
  • Are non-transferable
  • Are not banked funds, gift cards, or stored value
  • Are non-refundable except where required by law or as expressly stated by Pudzee in writing

Unused credits or add-on access units do not entitle you to a cash refund, extension, or compensation.

If a specific product flow permits deletion of an unengaged item and internally restores an available credit balance, that is an internal Service accounting adjustment only. It is not a monetary refund and does not create any right to money back for the original purchase.

4. No Refunds for Market, Product, or Subjective Reasons

Refunds will not be issued for reasons including:

  • Trading losses, gains, or missed opportunities
  • Missed, delayed, partial, duplicated, corrected, stale, or unavailable alerts
  • Market volatility, gaps, halts, illiquidity, or unexpected market behavior
  • Data latency, model behavior, analytical disagreement, or dissatisfaction with outputs
  • Inability to match, mirror, or reproduce a trade, fill, timing, or result
  • User error, misunderstanding, misuse, device issues, browser issues, internet issues, or local connectivity problems
  • Personal circumstances, scheduling conflicts, or failure to use the Service during the access window
  • Third-party broker, exchange, prop-firm, or market-data issues unless they also constitute a material outage under Section 6 and Pudzee chooses to provide a remedy

5. Cancellation and Incomplete Checkout Attempts

If you abandon, close, or otherwise do not complete a checkout flow before payment is successfully completed, no completed purchase has occurred and no refund is owed.

Pending or incomplete purchase attempts may expire automatically.

Once a purchase is successfully completed and access is issued or activated, there is no cancellation right and no pro rata refund except as expressly stated in this Policy or required by law.

6. Limited Exceptions

Refunds, replacement access, credits, or other adjustments may be considered only in the limited circumstances below, in Pudzee's sole discretion unless applicable law requires otherwise.

6.1 Duplicate Charges or Clear Billing Errors

Demonstrable duplicate charges or clear billing errors may be corrected through reversal, refund, or other appropriate adjustment.

6.2 Material Platform-Wide Outages

A material outage means a platform-wide failure that prevents a majority of paying users from accessing core paid Service features for a substantial portion of the applicable paid access window.

If Pudzee determines that a material outage occurred, Pudzee may choose, in its sole discretion, to provide one or more of the following remedies:

  • Replacement access
  • Extended access
  • Service credit
  • Partial refund
  • Full refund
  • Another commercially reasonable adjustment

Localized, user-specific, device-specific, browser-specific, ISP-specific, broker-specific, exchange-specific, or connectivity-related problems do not constitute a material outage.

6.3 Non-Waivable Legal Rights

Nothing in this Policy limits any non-waivable right you may have under applicable law.

7. Chargebacks, Disputes, and Payment Investigations

If you believe a charge is incorrect, you should contact Pudzee support first.

Initiating a chargeback, payment dispute, or similar payment reversal may result in temporary suspension or restriction of access while the matter is reviewed.

Pudzee reserves the right to:

  • Contest chargebacks or payment disputes
  • Provide this Policy, the Terms of Service, access records, payment metadata, and related records to payment processors, banks, or dispute handlers
  • Restrict or terminate access where fraud, abuse, duplicate access, or policy violation is suspected
  • Recover associated administrative costs where permitted by law

8. Suspension, Termination, and No-Refund Consequences

To the maximum extent permitted by law, Pudzee may suspend, restrict, or terminate access without refund if we determine or suspect:

  • Fraud, abuse, chargebacks, or payment misconduct
  • Account sharing, unauthorized redistribution, or rebroadcasting
  • Credential misuse or unauthorized access
  • Violation of the Terms of Service or any incorporated policy
  • Any legal, operational, reputational, or security risk associated with the account

Loss of access due to suspension, restriction, or termination under the Terms of Service does not create a refund right unless required by law.

9. Taxes and Third-Party Payment Processors

You are responsible for all applicable taxes, duties, and governmental charges associated with your purchase or use of the Service, excluding taxes based on Pudzee's net income.

Payments may be processed by third-party processors, and your use of those processors may be subject to their separate terms, policies, and dispute procedures.

10. Changes to This Policy

Pudzee may modify this Policy from time to time. Changes apply prospectively unless otherwise required by law and are effective when posted or on the effective date shown in the updated Policy.
