This Risk Disclosure Statement ("Risk Disclosure") applies to all access to and use of the Pudzee Copilot platform and related software, tools, dashboards, browser extensions, and services (collectively, the "Service"), operated by Pudzee LLC ("Pudzee," "we," "us," or "our").

This Risk Disclosure is incorporated by reference into the Terms of Service and must be read together with the Trading & Market Data Disclaimer. Capitalized terms not defined herein have the meanings set forth in the Terms of Service.

1. General Risk Acknowledgment

Trading and investing in financial markets involves substantial risk, including the risk of losing some or all of your invested capital.

You acknowledge and agree that:

  • Financial markets are inherently unpredictable
  • Losses can occur rapidly and without warning
  • No system, software, analysis, or methodology can eliminate risk

You should not trade with funds you cannot afford to lose.

2. No Risk Management or Protection

The Service does not:

  • Manage or control risk on your behalf
  • Limit or prevent losses
  • Protect capital
  • Ensure favorable outcomes
  • Substitute for independent judgment or professional advice

Any features, labels, or descriptions that may be perceived as evaluating "risk," "health," "quality," or similar concepts (including features described as Trade Health) are interpretive and informational only and do not reduce or manage trading risk.

3. Market Volatility and Structural Risks

Financial markets may experience:

  • Sudden or extreme volatility
  • Rapid price movements
  • Illiquidity or thin trading conditions
  • Price gaps, slippage, or dislocations
  • Exchange halts, suspensions, or rule changes
  • Unforeseen economic, political, or geopolitical events

Such conditions may result in losses regardless of analysis, preparation, or experience.

4. Futures, Options, and Leverage Risks

If you trade futures, options, or other leveraged instruments, you acknowledge that:

  • Leverage magnifies both gains and losses
  • Losses may exceed initial margin or deposits
  • Positions may be liquidated without notice
  • Margin requirements may change rapidly
  • Certain strategies may not be suitable for all users

You are solely responsible for understanding the risks of any financial instrument you trade.

5. Model, Analytical, and Interpretation Risks

The Service relies on analytical models, assumptions, heuristics, and interpretive frameworks that:

  • May be incomplete, oversimplified, or incorrect
  • May fail during unusual or extreme market conditions
  • May produce conflicting, unstable, or misleading interpretations
  • May change without notice

Outputs may appear authoritative, confident, precise, or actionable but still be incorrect.

Models represent interpretations, not reality.

This includes interpretations related to market structure, Options Flow analytics including model interpretations of gamma, vanna, charm, and related options-market dynamics, and internal classifications of market states. These frameworks are simplified representations and may not reflect actual institutional behavior or real-time positioning.

6. Data and Technology Risks

You acknowledge risks associated with:

  • Delayed, incomplete, inaccurate, or corrupted market data
  • Third-party data provider outages or errors
  • Software bugs, system failures, or unexpected behavior
  • Network latency, connectivity issues, or browser limitations
  • Hardware, operating system, or device incompatibilities

Outputs may appear complete or current even when underlying data is delayed, incomplete, or unavailable.

7. Human, Behavioral, and Psychological Risks

Trading decisions may be adversely affected by:

  • Emotional stress or pressure
  • Cognitive bias or overconfidence
  • Fatigue or distraction
  • Misinterpretation of information
  • Behavioral responses to market conditions

The Service does not account for, correct, or mitigate these human factors.

8. User-Controlled Input Risks

If you enter data, assumptions, parameters, trade ideas, or preferences into the Service, you acknowledge that:

  • Outputs depend on the accuracy and completeness of your inputs
  • Incorrect or incomplete inputs may produce misleading outputs
  • Pudzee does not verify or validate user-provided information

9. Session-Based Access and Timing Risks

Certain Service access mechanisms are limited to defined time windows.

You acknowledge and agree that:

  • Market conditions may change rapidly before, during, or after an access window
  • Access expiration may occur during periods of volatility
  • Exchange halts, early closes, or unexpected events may affect session dynamics
  • Pudzee does not guarantee uninterrupted access during any specific market condition

You assume all risks arising from timing, access windows, and session-based limitations.

10. Availability and Continuity Risks

The Service may be modified, limited, suspended, or discontinued at any time, temporarily or permanently, with or without notice.

You should not depend on the Service for continuous availability, monitoring, or decision-making.

11. Regulatory and Legal Risks

Laws, regulations, exchange rules, and market practices may change and may affect:

  • Market behavior
  • Trading strategies
  • Data availability
  • The relevance or interpretation of information presented by the Service

Pudzee does not monitor or advise on regulatory compliance for your trading activities.

12. Assumption of Risk

By accessing or using the Service, you expressly acknowledge and agree that:

  • You understand and accept all risks described in this Risk Disclosure
  • You assume full responsibility for all trading decisions and outcomes
  • Pudzee shall not be liable for losses, damages, or consequences arising from your trading activities or use of the Service

13. Condition of Use

Access to and use of the Service is expressly conditioned upon your acknowledgment of and agreement to this Risk Disclosure.

If you do not understand or accept these risks, you must not use the Service.

14. Precedence

This Risk Disclosure is incorporated into and governed by the Terms of Service. In the event of any conflict or inconsistency, the Terms of Service shall control.
