Risk Disclosure

This Risk Disclosure Statement ("Risk Disclosure") applies to all access to and use of the Pudzee Copilot platform and related software, tools, dashboards, websites, browser-based panels, communications, and services (collectively, the "Service"), operated by Pudzee LLC ("Pudzee," "we," "us," or "our").

This Risk Disclosure is incorporated by reference into the Terms of Service and must be read together with the Trading & Market Data Disclaimer. Capitalized terms not defined here have the meanings given in the Terms of Service.

1. General Risk Acknowledgment

Trading and investing in financial markets is speculative and involves substantial risk. You can lose money quickly, lose your entire account balance, and, in the case of leveraged products, lose more than your initial margin, deposit, or expected risk amount.

You acknowledge and agree that:

Financial markets are inherently uncertain and can change rapidly without warning
No software, commentary, alert, model, dashboard, or analytical framework can remove or eliminate trading risk
Even disciplined traders can experience rapid losses, slippage, missed executions, and materially adverse outcomes
You should not trade with money you cannot afford to lose

2. No Risk Management or Protection

The Service provides informational, analytical, and commentary-based tools, which may include trade alerts, Execution Map levels, Trade Desk Insights, Performance Dashboard views, Market State, Market Internals, Options Flow, and related outputs.

The Service does not:

Manage your account or positions
Place, route, stage, cancel, or supervise your orders
Set or maintain stops, targets, hedges, or position sizes for you
Monitor your margin, buying power, drawdown, daily loss, or compliance limits
Protect capital, prevent losses, or guarantee favorable outcomes
Substitute for independent judgment, professional advice, or your own risk controls

Any labels or descriptors that may sound risk-related, such as confidence, strength, quality, stability, health, or similar terminology, are informational only and do not reduce, cap, or manage your actual trading risk.

3. Trade Alert, Timing, and Execution Risk

The Service may publish trade alerts or near-real-time commentary regarding entries, scales, reductions, exits, and related market developments. You acknowledge and agree that:

Alerts may be delayed, partial, corrected, revised, canceled, duplicated, out of sequence, or unavailable
By the time you see an alert or related commentary, the market may already have moved materially
Prices, levels, and commentary shown in the Service may not be available, fillable, or reproducible in your account
You may be unable to match any alert because of latency, slippage, volatility, liquidity, commissions, fees, broker routing, platform behavior, exchange rules, prop-firm restrictions, account size, or margin constraints
Pudzee and its personnel may act at different prices, times, sizes, or under different account conditions than you
Pudzee has no duty to provide every alert, update, scale, reduction, exit, or related account action

Any decision to act, delay, ignore, or attempt to mirror an alert is made solely by you and entirely at your own risk.

4. Analytical, Model, and Interpretation Risk

The Service relies on analytical models, heuristics, assumptions, internal classifications, manual commentary, and third-party data inputs. These may be incomplete, oversimplified, unstable, or wrong.

This applies to, among other things:

Execution Map levels and structural references
Trade Desk Insights commentary and live trade analysis
Performance Dashboard metrics, summaries, and logs
Market State classifications and confidence readings
Market Internals analytics
Options Flow analytics, including gamma, vanna, charm, and related interpretive terminology

You acknowledge and agree that:

These outputs are interpretations, not verified facts
They are not factual statements about dealer positioning, institutional intent, future price direction, or guaranteed support or resistance
Outputs that appear precise, timely, high-confidence, or actionable may still be incorrect, incomplete, stale, unstable, or misleading
Different models or methodologies could reasonably produce materially different interpretations from the same underlying data

5. Market Data, Technology, and Access-Window Risk

You acknowledge risks associated with:

Delayed, incomplete, inaccurate, corrupted, or unavailable market data
Third-party data feed outages, exchange issues, or upstream provider failures
Software bugs, synchronization errors, browser issues, WebSocket interruptions, connectivity failures, or device incompatibilities
Session-window, pass-window, or entitlement expiration during volatile or time-sensitive periods
Early closes, halts, late opens, holiday schedules, or other market-structure disruptions

The Service may appear current or available even when some underlying data is delayed, stale, missing, or degraded. Pudzee does not guarantee uninterrupted availability during any particular market condition, session window, or trading period.

6. Performance Dashboard and Published Results Risk

The Service may display performance metrics, account summaries, trade logs, win rates, profit factors, durations, charts, or other performance-related information.

You acknowledge and agree that:

Performance information may reflect Pudzee-designated accounts, linked trading-account/profile data where applicable, or internally compiled records and summaries
Performance information may be derived from broker data, platform exports, internal logs, reconciliations, corrected records, or other internal accounting methods
Performance information may be provisional, delayed, incomplete, unaudited, restated, reclassified, or corrected from time to time
Published or displayed results are not a guarantee, prediction, or representation of your likely results
Differences in contract size, instrument choice, fees, liquidity, latency, fills, broker technology, prop-firm rules, and account constraints can produce materially different outcomes from the same general market idea or alert
Past performance, displayed statistics, and historical examples are not indicative of future results

7. Futures, Options, Broker, Prop-Firm, and Regulatory Risk

If you trade futures, options, or other leveraged products, you acknowledge and agree that:

Leverage magnifies both gains and losses
Losses may exceed initial margin or expected risk parameters
Positions may be liquidated, reduced, rejected, or restricted without notice by brokers, exchanges, or prop firms
Margin requirements, risk controls, buying-power rules, drawdown limits, position limits, and trading-hour restrictions may change rapidly or be enforced in ways that prevent you from executing as intended
You are solely responsible for complying with all broker, exchange, prop-firm, platform, tax, legal, and jurisdictional requirements applicable to your activity

Pudzee does not monitor your compliance obligations and does not advise you on regulatory, broker, exchange, or prop-firm compliance.

8. Human, Behavioral, and Execution Risk

Trading outcomes may be negatively affected by human and behavioral factors, including:

Stress, fatigue, distraction, or panic
Overconfidence, hesitation, or cognitive bias
Misreading a chart, alert, level, or commentary item
Delayed reaction time or manual execution errors
Entering, sizing, managing, or exiting trades inconsistently with your plan

The Service does not account for, control, or mitigate these human factors for you.

9. No Duty to Monitor, Update, or Maintain Continuity

Pudzee has no duty to:

Update outputs in real time
Correct errors immediately or at all
Notify you of changing market conditions, execution conditions, or account conditions
Monitor your trades, account, risk, pass window, or compliance status on your behalf
Keep the Service continuously available, synchronized, or operational without interruption

The Service may be modified, limited, suspended, or discontinued at any time, temporarily or permanently, with or without notice.

10. Assumption of Risk and Responsibility

By accessing or using the Service, you expressly acknowledge and agree that:

You understand and accept the risks described in this Risk Disclosure
You assume full responsibility for all trading decisions, account activity, risk management, and outcomes
You are solely responsible for all losses, missed opportunities, fees, commissions, taxes, penalties, liquidations, prop-firm breaches, and other consequences arising from your market activity
Any liability issues relating to your use of the Service are governed exclusively by the Terms of Service

11. Condition of Use

Access to and use of the Service is expressly conditioned upon your acknowledgment of and agreement to this Risk Disclosure.

If you do not understand or accept these risks, you must not use the Service.

12. Precedence

This Risk Disclosure is incorporated into and governed by the Terms of Service. In the event of any conflict or inconsistency, the Terms of Service control.
